Welcome to Vistara Cloud. These Terms of Service ("Terms") govern your access to and use of the Vistara Cloud platform, websites, and services (collectively, the "Services") provided by Wappnet Systems ("Company", "we", "us", or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. Acceptance of Terms
By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Wappnet Systems.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.
2. Description of Services
Vistara Cloud provides a multi-cloud management platform that enables users to:
- Manage object storage services across multiple cloud providers (AWS S3, Google Cloud Storage, Azure Blob Storage, Digital Ocean Spaces, Hetzner Object Storage)
- Access and manage cloud resources through a unified interface
- Collaborate with team members with role-based access controls
- Connect and manage cloud infrastructure (upcoming features)
3. Account Registration and Security
To use certain features of our Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access or use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.
4. Cloud Provider Credentials
Our Services require you to provide credentials (such as IAM access keys, service accounts, or API tokens) to connect to third-party cloud providers. By providing these credentials, you acknowledge and agree that:
- You have the necessary rights and authorization to provide such credentials
- You are responsible for the security and proper configuration of your cloud provider accounts
- We will store your credentials using industry-standard encryption methods
- We will only use your credentials to provide the Services as described
- We are not responsible for any actions taken on your cloud provider accounts that result from compromised credentials that were not compromised through our Services
5. User Responsibilities
You are solely responsible for:
- All data, content, and files stored in your connected cloud storage services
- Ensuring compliance with your cloud providers' terms of service
- Managing team member access and permissions within your organization
- Backing up your data and maintaining appropriate data retention policies
- Ensuring that your use of the Services complies with all applicable laws and regulations
6. Prohibited Uses
You agree not to use the Services to:
- Violate any applicable laws, regulations, or third-party rights
- Store, transmit, or distribute any malicious code, viruses, or harmful content
- Interfere with or disrupt the integrity or performance of the Services
- Attempt to gain unauthorized access to the Services or related systems
- Use the Services for any illegal, fraudulent, or harmful purpose
- Reverse engineer, decompile, or disassemble any part of the Services
- Resell, sublicense, or redistribute the Services without our written consent
- Use automated means to access the Services except through our official APIs
7. Data Handling and Privacy
We take your privacy seriously. Our data handling practices are described in our Privacy Policy. Key points include:
- We do not store your cloud data: Vistara Cloud acts as an interface to your cloud storage. Your files and data remain on your cloud providers' servers and are not stored on our servers.
- Credential security: Cloud provider credentials are stored using AES-256 encryption and are only decrypted when needed to perform authorized operations.
- Access logs: We maintain logs of access to your connected services for security and audit purposes.
8. Intellectual Property
The Services, including all content, features, functionality, software, and technology, are owned by Wappnet Systems and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.
You retain all rights to your data and content. By using the Services, you grant us a limited license to access and process your data solely for the purpose of providing the Services.
9. Third-Party Services
Our Services integrate with third-party cloud providers (AWS, Azure, Google Cloud Platform, Digital Ocean, Hetzner, and others). Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices, policies, or content of these third-party services.
10. Service Availability and Modifications
We strive to provide reliable and continuous service, but we do not guarantee that the Services will be available at all times. We reserve the right to:
- Modify, suspend, or discontinue any part of the Services at any time
- Perform scheduled maintenance with reasonable advance notice
- Update these Terms with notice provided through the Services or via email
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will meet your specific requirements
- The Services will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Services will be accurate or reliable
- Any errors in the Services will be corrected
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAPPNET SYSTEMS AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, use, goodwill, or other intangible losses
- Unauthorized access to or alteration of your data or transmissions
- Statements or conduct of any third party on the Services
- Any other matter relating to the Services
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify, defend, and hold harmless Wappnet Systems, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
14. Termination
You may terminate your account at any time by contacting us or using the account deletion feature in the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Services will immediately cease
- We will delete your account data in accordance with our Privacy Policy
- Provisions that by their nature should survive termination will survive
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Services shall be resolved through:
- Good faith negotiations between the parties
- If negotiations fail, binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India
- The courts of Ahmedabad, Gujarat, India shall have exclusive jurisdiction
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wappnet Systems regarding the use of the Services and supersede any prior agreements between you and us.
